I recently filed a small claims action against an auto insurer for $1,600.  They are now being represented by an attorney and the case is being transferred from small claims to a civil court.  How can this happen? What are the ramifications of the case being in civil court. Can I be held liable for attorney's fees? I live in Pima County, Arizona if that helps?

June, Although I am not an attorney, I can only venture an observation. People or businesses who have money always have the advantage over those of us who do not. If your cause is legitamate then you will have nothing to fear. In fact, under the circumstances that you elaborated on you will probably get your court costs along with your money. But you must rely on your attorney. Listen, but don's act until you truly understand what your attorney is sayiing. You hired him, but he didn't hire you. Good luck. Michael Joel Held
