I am co-defendent. my boyfriends house got a probaition search. before the police came to the house , I was asleep on the couch. then went to the bathroom upstairs. While I am in the bathroom i hear a loud knock at the door. I finished what I had to do, I came back down stairs to greet the police. they asked me if MATT FERREIRA was there? I said Im not sure if he is or not, i was asleep on the couch, he is suppost to be at work. the cops said ,..well we need to come in to make sure he isnt in the house,so i let them in. they started asking me my name and ran my name. it came up clean. the next thing i know i hear a bunch of yelling coming from upstairs. matt was home. i didnt know that. anyway, so then they start to accuse me of knowing that he was there. how am i suppost to know, im asleep. so they put me in handcuffs and put me under arrest. i said for what? they said i resisted and they found a backpack with a needle in one of the pockets . they asked if the backpack was mine? i said yes . but the thing about it was that my backpack wasnt in matt s room room , it was in the next room. Im not on probation or anything. i have never been to prison. they took my phone and was answering it and telling people on the other end, that im in a back of a cop car where i belong. yelling profanitys at me. I asked him what his badge number was, he didnt give it to me. I asked him to call a CHP to stand as a witness , they didnt do that. they searched me w/ out a female cop being present. my boyfriend has a 4way search claws. they can only search where he is in control of. right? they also took some mail of mine that wasnt opened out of my backpack. so we are in the cop car for about an hour and half while they search the whole house. so later they take us to jail. my boyfriend is being charged w/ recieving stolen property , under the influence. they charged me w/ resisting arrest , lieing to a cop and under the influence. he got bailed, i had to stay until i went to court. he got an attorney. i had a public defender. he got 45 days . i pleaded not guilty. so im going threw the steps to pre-trial. they are asking me to do NA classes, ive been doing that. now they are throwing me deals. they want to give me , 3 yrs probation w/ claws ,100 dolllar fine. pick up trash, and go to classes. or file to have the case suppressed. but if i lose, then that can land me in county for a year. i dont feel Im getting treated fairly. please tell me what i can do. i dont feel those cops had any right to arrest me or search my things and answering my phone. Way unprofessional. left his moms house in a wreck for her to come home to after work. (she keeps her house really neat). Oh! and they took her phone to, and they wont give us our phones back.
they also took a urine sample . they have said nothing about it , i asked them about it and they cant find it. so w/ out that , they dont have a case right? do they have to drop all charges?
