Hi My wife past away due to cancer she has 38,000 in the social system they told me I canot collect from her SS only a one time shot of 175.00 also I made too much and it was not set up that way for a man to be left with out his wife only the women will get husband money can you help cause I would like to know if I could get her money she worked all her life here Tim I could use it

I would call the main number of Social Security (1-800-772-1213) and ask them to clarify your situation. Also take a look at this web page for additional information that might be of help to you.

The death benefit for Social Security is $255, I believe.  As for your wife's benefits, if you were on social security benefits, you would get the greater benefit amount between you and your wife.  If not, you get the death benefit.  if you have children, they are eligible to receive Social Security benefits up to 16, I believe.  This all depends on the number of quarters your wife had in the system, and if she had enough.  With 38,000 in benefits contributions, I am sure she has enough.  Contacting Social Security is an excellent idea, but be prepared, the reality is that you very well may not get he money she put in.  Social Security does not function like an IRA or 401K in that way.
