Can dogs be off leash on private land virginia

I walk both my dogs on a privately owned trail (It's owned by the local Home Owners Association) This morning I fell, it has been snowing heavily, and let go of both leashes. Both dogs are extremely social and friendly, unfortunately, one of my dogs ran toward a very unfriendly German Shepherd, which was leashed. The Shepherd attacked my dog as did it's owner, who was beating my dog with a huge stick. My dog was yelping and trying to get away. The owner then turned on me yelling all sorts of insults and informing me that he was going to have my dog destroyed and me prosecuted. Can he do this?  There have been complaints in the neighborhood about the German Shepherd as it is extremely dog aggressive.
