I had asked the court for a guardian ad litum to be appointed in the matter of my daughter, who has subsequently admitted that she never really even read the case, exhibits no impartiality, ignores the legal documentation on my behalf that I submit, and overtly yields to the wishes of the father, without substantiation. She disregrads my 12 year old daughter's requests regarding visitation and has subjected her to her own manipulations (on behalf of the father). Is there a source regarding the Calif. state guidelines for visitation, restrictions in visitation, and remedy when the court appointed attorney is not engaging in neutral, objective conduct on behalf of my daughter? The father, his own attorneys and this woman have successfully obstructed and frustrated my parental rights and visitation. I have no attorney (after having invested many thousand in one years ago, who was inexperienced and may as well have been working for oppositional counsel). I believe I will have better advantage and regard from the judge if I am able to cite California Family law statutes/codes requiring any obligations of the court to have to consider all of my legal documentation (in- cluding my DOJ records which reflect no criminal history) that disputes the father's allegations. I have an impeccable DMV record, but my daughter's attorney has even arbitrarily imposed a restriction that I am lot allowed to even transport her in my car. She was asked to contact wtnesses, including Kaiser physicians in this case, and she simply does not bother to follow through. She makes her recommendations on the basis of unsubstantiated opinion, not on fact. Because they have prevailed for so long and because I seem to have a different judge every time this case is heard, I never seem to be able to gain any leverage (SF Superior court). There must be some recourse/remedy for dealing with the failings of this individual to authentically repre- sent the interests of my daughter and to compel her to stop obstructing my rights. Sure- ly there must be an avenue for filing a formal complaint, including against the Family Court for failing to regard the FACTS, not merely the allegations, in this case. Any recommendations would be gratefully appreciated.
