in tx what constitutes child abandonment? my youngest daughter has stayed with her fathers parents while i work 2 jobs, i call and visit and keep her on my days off as much as i can. i have arranged daycare and have always told them i have someone to watch her, and their reply has always been, no just let her stay here it will save you money and we love to spend time with her. i failed to mention her father was incarcerated for 4 months. now his parents are trying to gain sole custody on the allegation of abandonment, although the child and both parents and child from previous relationship all lived together as a family for the past 3 months. recently split up, we were never married. i have always worked and supported the family for the 5 years we have lived together.,, what is your take on this mess

I think that you should take your child and distance yourself from them. Only if you live in a home with your child and are supporting him/her will the courts see you as a viable mother.

In court they will not win your child, if you are a good, caring mother who supports her child. You can arrange daycare, and reasonable visitation with them and your child to make it fair.

The law works but the system needs changed, We all abide by the law but sometime it failes us. The same with the goverment. God bless the USA, Brign our troops HOME safely, To the men who did not get the credit they deserve, MAY GOD WATCH OVER OUR SERVICE MEN.

Child abandoment can be seen in many ways in the eyes of the courts as , being left alone to care for them selves or a parent neglecting a child. As for your question it looks to me as you'r dowing what is right but i highley suggest you contact an attorney for his openion on this matter now who doo these children belong to and who is the father and mother as you don't say outher than a previous relationship if the children are his he may get get the custody depending on the facts or there real mother may get custody there are many facts in this case that must be answered. If the young lady is the real mother she may have a claim to them but if a case his and whoevers or hers and whoevers it is gowing to be all up a court of law to settle. As you state the father is incarcerated for charge is unknown if it is a feloney he may not get custody depending on the judges ruleing in this case who does have a legal right to these children. Then the fact of texas law will prevail as every state and Social Services who must be involved in this matter look at it as all factors must be looked at now Childrens Services may say that these children may say they go to foster care. But the best advice consult an attorney to get this matter resolved.As it will all be up to Social Services and the judge. Best of luck In  resolving this matter.
